SETTLEMENT SERVICES
We have developed a unique claim modeling process that allows us to identify High Exposure (HE) claims with a high likelihood for settlement, determine an accurate future anticipated exposure and present value of these HE claims. Our negotiators have over 50-years of combined experience in the Workers' Compensation arena and all have been rigorously trained to accurately value and negotiate the settlement of HE claims. Our expertise allows us to act as special negotiators on behalf of our clients and facilitate settlements of HE claims. We have also developed a strong understanding of the Medicare Set-Aside process as it relates to the requirements of Medicare and the Center for Medicare Services (CMS) and provide assistance to our clients in navigating through these requirements in order to gain approval. In our role as special negotiators we do not function as an advocate for either the defense or applicant in the settlement negotiation. Our responsibility is to determine the value of the claim and negotiate a settlement that is satisfactory to all parties involved. We estimate that between 2-5% of all Workers' Compensation claims are HE claims yet, due to the high expense of medical inflation, they can account for between 50-80% of costs from our client's Workers' Compensation program. We have been successful at settling over 80% of these cases allowing our clients to realize hundreds of millions of dollars in real world savings as well as reducing their reserves and lowering their experience modifiers.
